came back with Edo Tensei, but Kabuto's the one controling it, so for all we know, Kabuto just has to decide not to regenerate Itachi, and cutting him in half will work. I'm pretty sure we've been supposed to see it that way ever since he turned around, he's been cautious, acting like getting hit would actually be lethal for him again.
As for the melee strike, Kabuto came out of the mouth of the Orochimaru double which he had just sent at them, so he struck from behind them both. That said, I'm pretty sure it's going to say he did activate Izanami in time and he'll come back, and his death is predetermined not to happen (as Izanami supposedly decides fate or whatever). If not, Sasuke's the one who's going to have to learn it out of nowhere.
If I struggled to the end of my determination, to the end of my way of life with my followers, if the result is ruin, then this ruin is inevitable. Grieve. Shed tears. But you cannot regret.
