I think you might have your facts wrong there though buddy. Eli made Tetsu from the ground up, and his own takes on Storm beyond that (such as the leaked Dark Storm K). He planned to release a fixed Silent Storm, but because he could never contact Storm so sat on it, leading to Tetsu's genesis in the first place.

Who was a parody by reu and bbh and uses to type in jeffK style. Silent Storm was famous for his overuse of the word lol to end everyother sentence lol. Just like d@rksun was known or ending every sentence with his trademakr smiley ^_^
And yep, the silent storm concept was originally silent storm's idea, it was eli who stole the concept, regardless of the quality of execution being much better in eli's side.

Saying that someone made SS from scratch I find funny. You can say they coded him or reripped his sprites and likeness. But no one but me made the copywrited original idea for him. And I did release Dark Storm before it wasnt leaked smh....I also released a newer capcom version of SS and also a version never seen. Because I lost interest years ago I gave freedom that version to remake. And I'm remaking hi in Hi Res with the help of others. Along with the rest of the original idea in my old time.
So stop giving people grief over releasing storm. I really don't mind what I do mind is giving other people so much credit for redoing my original idea. Give that a rest and enjoy characters life is too short for arguing about fighting game creations.
And for the record I was not famous for any parody. What makes him famous these days is he was the first black superhero people remember. Who wasnt a college drop out or drug dealer trying to reform. Like most black people are betrayed in games. I made it although not that well back then as more of a inspiration. And it did just that because even to this day I still get random people a day saying whats up and thx. I have been watching over the years the rumors and people making their own accounts of what SS is. But ignore all of that the above is the reason he was made. And I promise you the new one is nothing like the old one and will take what I wanted to do a step further.
As far as this creation I like it vintage smooth and refreshing enjoy it and stop gossip girling the release.

Hey! I want to ask, there WAS a previous Silent Storm. It was Tetsu patched made to look like Silent Storm, and he had Kusanagi's (from KOF) voice. But he was done a LONG time ago, he didn't have all the moves the current Tetsu does. Do you think you can repatch that SS one?

The reason this character has Eli's CHM is because it's basically Darkstorm K. The code is all Eli's as far as I could tell, there might be a few edits in there. The sound is probably eli's too, as only Eli's original Silent storm said "Hyper Cyclone Kick." There are still a few things different from Eli's private version, but it is the closest remake so far. (after all, Darkstorm K was simply an edited StormEX.)

So let's refresh this: Silent Storm (the creator) gave permission for a character whose coding and sprites were not made or ripped by him but by XCB and made for Tetsu, and he thinks it flies as fair permission because he created the Silent Storm concept.

Actually already did. A side by side comparison of the DNA coding files between this and Tetsu confirms they match identically to a T: while there were additions at the tail end, it's Tetsu's coding, no doubt about that. Not even coding order and file structure was changed.

I'll make this really REALLY simple sheesh. I copywrited the likeness and theme of SS not the sprites. The sprites was just a temporary vessel for the idea. All anyone has done is redo the theme I really started. Doesnt matter if they reripped or reprogrammed it. It's still the same idea I freely allowed out to the public. So if they didn't want anyone to (NOT) use it they shouldn't of basically copied the idea over again I (FREELY)put in the public. So again stop drama queening this not a big deal.
As someone said its a tribute and I like it so enjoy it :)

The "likeness" of SS is based off those sprites. Especially given a significant of your "copyrighted character" is represented in the game's moveset options for the character? That is effectively saying you can claim a copyright on anything made from the game using that character's sprites.
So to get it up front, you gave 'permission' for the character as a whole and not just the likeness and name, am I understanding this right?
Oh and you missed the point of the tribute post, it's a bit of sarcasm that relates to Warner, but you weren't here for that fun bit anyway.

The likeness is of a young black man with the powers or wind and lightning. I can alter it anyway I see fit if i wanna alter golden axe sprites and call it SS. I approve this character I give full permission to anyone who wants to remake it. Because I made it to be shared to all. Not to be hidden in the corner of the internet for idiots to say I made my own you cant have it. That defeats the whole purpose of making it in the first place. It's fan fiction expression of a idea. Anyone me included who makes a mugen character is subject to it. And has no rights or laws to even say something we created and willingly upload to the net cannot be used unless its SOLD! Unless that happens you have NO rights or legal bearings. And even then if its sold unless you do what I did with the theme and likeness. You can't say or do anything and its not disrespecting you if people use it. Because in a court of law YOU yourself are guilty you uploaded it in the first place. I watched people get bitched out for years over some fictional law thats not even a real law. And that shit stops forever right now! People can quote me if you don't want your character used don't put him on the net. Put him on a cd flash drive or anything else not public. If someone else finds uses and ripps it apart don't come crying here or anywhere else.

his art based off of my idea that I didn't mind him remaking. Problem is he has no right to then say hey its mine I don't want you to use it. Also he has ZERO legal basis to do so at all. Especially if he himself shared it to the world. If he didn't want it used he should of not put it on the net end of story. And again didnt I just say the policing is over? Meaning you upload it its no longer your right what happens to it after its freely distributed. So if you don't want that to happen don't put it on the net. And make sure you can trust others. If it gets out too bad for you but dont bitch either because you put it there. And offically XCB fanart is based off mine where did he get the idea to run a red Gi black guy around with storm powers. Um me someone took his version of my SS and made another better SS. The idea evolved and got better its called evolution and having fun. Why has this evolved into a question of copyrights rather than a matter of respecting the original creator? What do copyrighting the sprites have to do with anything? It shouldn't matter unless someone's trying to sell them. :S

Mild correction. And Robert, your example isnt very good, companies do exactly that of using work based on their IPS, Marvel gave capcom things done by other artists to trace ( joe mad spiderman portrait on marvel super heroes for instance) , capcom turned Streetfighter rainbow and used from it what they found good.
What everyone is forgetting is that no matter what SS gives permission or not, in the guild, permissions arent a issue.
I dont know if SS thinks he is eli spokesperson or something to tell who can or can not use what with others permission, but that, the permission thing, is a non issue on the guild as long as not blatantly rude "ex: ahah I edited your character to have a penis for a face!" or " I release your character with another pallete just to spite you! ALL CREDITS TO MEEEEE! did it from the ground up!"

I look at it as tribute flattery fan art and evolution of the idea. Although I won't be using this version anymore as the template. I'm glad it touched so many to spawn so many remakes. Just enjoy them and stop making it such a big deal its really not.

It's your idea, you're (silly, run into the ground) concept. We got that already. He never released any version of Storm publicly because he couldn't even reach you for the permission you keep harping about.
The point instead is you telling someone it's okay to use someone else's material that you didn't make. Especially given the base material is still easily recognizable as Tetsu, which last I checked didn't call himself Storm, makes a big point not to call him Storm, and if he is black is officially the palest fellow ever.

You're telling someone it's OK to distribute a character that has nothing to do with you other than an idea and a skin tone. In other words, you didn't code the SS this one was based off of, XCB did. This isn't YOUR Silent Storm (please don't bring up your idea/concept/black superhero thing again, we get it), it's the one XCB made.
XCB should be the only one here giving permission, as the one who did the raw coding is the issue.
EDIT: Ok, I realized that someone might come back with "I don't care about permission, who cares, just play" or something of that nature. Due to Guild's new rules, that's all well and good, but just don't give permission for something that's not yours.
Example: You have a bike, and you get an idea that you're going to put a yellow lightning sticker on it. Your friend John has the same bike, and puts 2 blue lightning stickers on his, because he thought your idea was cool. Now John's friend borrows John's bike, puts a flame sticker on it, and wants to sell (I'M NOT RELATING THE WORD "SELL" TO MUGEN) this design of the bike. You can't give permission to John's friend to sell it just because it was inspired from yours, because it's not your bike. It's John's bike. He did the work of putting the blue stickers on.
Bike = Original guy's sprites from Kakuge Yaro
Idea of putting the stickers on = Your idea of the black superhero
Yellow sticker = Your original code
Blue stickers = XCB's code (he didn't edit yours IIRC)
Flame sticker = Fr33dom87's edits of XCB's code

there is also the gpl and lgpl licences too, which most people love to ignore, and basically states that if you take anything open soruce your work automatically becomes open source.

Here's one complication for you Stormy: that entails you be respectful about it even in the basest of forms still. And you're behaving like a perfect arrogant ass. "My world, my rules, blah blah blah." And I thought I sounded like a prick sometimes.
Also to point out the original author was NOT properly credited, which Guild requires. The readme and DEF files state the character is not XCB's. Seems to me to credit someone that's a pretty big thing to fib about.

coding in mugen doesnt automatically make your stuff opensource
Mugen's character code at the base level is open source. All those triggers and sctrls are all there. It's not a compiled program with complex functions and named variables doing specific stuff to form a concentrated whole.
It's just a few files put together to form something. The files are accessable through wordpad, or can be extracted with freely downloadable tools. It's not designed to be closed off in any way. Trying to enforce any sort of copyright or whatever on this is an exercise in futility.
All that keeps people from rampant sprite swaps is some are polite, and that most of the time sprite swapping doesn't get you much fame once it's pointed out.

Unfortunatly that is a lie, since it IS Eli's character, that has been slightly modified. And Eli isn't listed as the creator. I think that's KFM's main point. It's just a convoluted version of someone making minor changes in a character and replacing the authors name with theirs. The only reason this is different is that someone thinks they have the rights to do anything they want with anything that bears resemblence to the "Silent Storm name and likeness."
Should you lift considerable parts from another piece of MUGEN content to use that in your "own" work without mentioning this fact to anyone and this circumstance is later discovered (very often, it is!), it would end up making you look pretty silly in many people's eyes.
But we would not ban you for it--if you admit your actions and don't act stupid about it. Needless to say, it would be better if you made it public knowledge just what you have taken from which source from the beginning (in a readme file, for example).
Example cases follow:
1) Let's say you "release" Eli's Venom with two different palettes, regardless of whether or not you say it's your own or Eli's, whether you're upfront about it or try to talk yourself out of it: you will at least be laughed at, "Haha this is just Eli's Venom with two new palettes, why didn't you just release the palettes separately? Did you think nobody would notice? :p" And if you'd really try to talk yourself out of something as obvious as this, you might get banned pretty fast. Liars get no love.
Ironic the example is from a character made by Eli :P
Now I don't think anyone needs to be banned, but it would be nice to see Eli properly credited as actually making that character. Since it's probably over 90% Eli's work.

Being based on and Slightly modifieing a character are quite different things.
Edit: I'm willing to concede that it could possibly be a textual misunderstanding. But with the way it was worded, made it seem like he was saying it was His work, and not Eli's.

Which was logical since it was Silent Storm giving permission, not Eli.

Because This was split from the release thread and feedback for the character goes there. Furthermore I downloaded the character 3 weeks ago, I compared it to Eli's original Silent Storm EX, and Tetsu. It's the closest remake of Eli's version that has been done so far. But considering it is made up of Eli's files that isn't suprising.

Said it in the other post saying it here. I originally made SS and then made a capcom version which was actually vastly superior to the original SS. Then made a cvs version which was even more superior but then I lost interest and quit. I never changed emails or screen names all these years. I was on Eli's buddy list so he didn't try that hard to find me. Hell you can still google me for god's sake.
Here's the order of things I made my SS
Eli made his based off my work
Freedom Edited his off my work/eli work
Things people dont get all eli did was take the capcom version of SS and stuff it into the older version. Because majority of the newer stuff in his version was from the second version of ss. Including the variable combo system that the original SS never had that eli's put in. I consider it all a tribute and say thanks to both of them. Because its just a evolution of the character and idea I stop working on. So I find it funny people keep bitching about certain things. It's not like he had a original idea making his version eli did that is. He just stuffed both versions into the old one. So he did some new code and reripped gave it a different pose (SIMILAR) to the capcom version. I said I don't care its all good have fun. Leave freedom alone because he choose to express his own vision. What he did was take something good and make it better. Like it love it live it and move along do a beta test and find bugs.
Which is why I'll give it out because they both did excellent jobs. And inspired me to remake him yet again along with the other characters in Hi def. So stop bothering innocent people with your tight pants bs rules that don't exist. Should really know by now your dealing with SS you aren't gonna win flaming me.

A point would be the sprites eli used are in fact out of the game kagekagu yaro or whatever it's called. Not capcom at all, however similar they may look.
Aside from taking the piss out of your old character, nothing in that is yours. I don't really care about the release but not giving people the wrong idea about what eli did here is important.

XCB did NOT copy anything from your versions of Silent Storm.
He Ripped the sprites from Kakuge yaro, he coded it himself. The only similarities that it had to your version's were the name and pallet. However he DID NOT release it, because he claimed he couldn't get permission. So he used the sprites he ripped and the programming he did, to make Tetsu Yatogi, and released that instead.
Your Silent Storm's play nothing like his, and never have.

I said sure no problem just use a disclaimer and he did end of story. Like I said its not about me saying ok use others people work. Thier something clearly saying its a edit and saying what its based off. He did what he was supposed to do. And even gave me a tribute by asking he really didnt have to anyway. So give it a rest no one cares what you think anyway. I got 20 ims open of people calling you a asshole and ignore you talking to me pleasantly. That said, the copyright is limited exclusively to content originating from the person who holds it, this applies to derivative works as well. HOWEVER, bearing the likeness of another property does not necessarily constitute a derivative work, and therein lies the issue.
The fact on the matter is, there is no industry where this is an issue that there is a clear agreement. But if you want an expert opinion, look no further than news sources and legal texts. This one in particular describes a 70% boundary for claiming copyright.

Whats copywrited is the name likeness theme and game idea. That has zero to do with mugen and is for my purposes elsewhere. I just imprinted the idea onto the old sprites. And it took on a life of its own over the years. Like I said when you inspire people for years to emulate copy and want your character. Be it the original or the next big thing clone. THEN come tell me about how much I suck. Also notice the time between my post I really don't hang around to argue. I have a son I see to him handle real life business play a little ps3. Then come back here and see about 10 more post of total waste of time lol. Like I said carry on you amuse me with your lack of respect of your own time on this.

Then people doubted I was the real me lol sigh..And then I get a crazy azz racist arguing at me. Then a few others who don't even know whats going on weighing in. And again eli's versions HE made even tetsu are blatant remixes of the old Ss and the newer capcom version. He didn't use the code or the sprites. But the same moves are there from both. And again I don't care and im glad he did it. What I'm doing now is lifting the ridiculous censor people have over my own creation. Yea he did his own version but its still based off mine. And i'm stopping the whole limit to it. Pretty soon none of this will even matter anyway with the new one coming.

Whenever you make something available on the Internet you run the risk of someone taking it and claiming it as their own. In MUGEN, it can be as minor as someone borrowing a block of code (something you probably wouldn't even notice in most instances unless you download every character and scan it for similiarities) to an entire character being ripped off. This kind of stuff has happened since the beginning of MUGEN, well before zealots for the cause started popping up and screaming in every thread. The fact of the matter is that there is no way you can stop this. You can put stuff forbidding it in your readme and people can still do it. We can ban people and people will still do it.
Furthermore, unless your creation is 100% original, the odds are you used sprites/sounds/concepts without permission (which some companies, but not all and it shouldn't be assumed as such, have said is okay) AND on top of that downloaded and used a ROM to do it (which NO company has or will EVER say is okay). I'm not condeming anyone for such behavior, as doing stuff like that is the nature of MUGEN. Instead I'm saying that causing a fuss over someone taking something of yours is more than a little hypocritical, and you should be aware of your own behavior before lashing out at others for doing the same.
There is a bright side, though. If someone were to, say, take the Street Fighter Alpha Chun-Li you converted for MUGEN, give it evil colors and label it "Evil Chun-Li", it's highly likely that no one would be fooled and that person would get no love from your peers. In addition, no matter what someone else does with your release, it can't take away from the experience you had making it and the value of the release itself.

Correction I gave permission for a and follow me on this....
Remake of a remake of my original character.
He did a hi res version thats all. With a few tweaks for people to enjoy not catch a heart attack over because SS was always limited because I wasnt around. Now I am and thats over and that about sums it all up. Plus as I said I don't follow imaginary rules someone stuffy made up. All of this was made to be shared or viewed in the first place. Like I said earlier yet again character is staying up along my other lost versions free to download and have people do as they wish. Thiers no debate here in the matter.
Also what people are forgetting is the second version of SS that all the supers of eli version actually are based off. The actual capcom version and again if it was flat out eli's version then I wouldnt of gave permission to it. But this is a edited version eli isn't around I originally DID give him permission to make that. I have never denied anyone who came to me and thiers been several. I gave freedom permission to do his edit version.

This kind of stuff has happened since the beginning of MUGEN, well before zealots for the cause started popping up and screaming in every thread. The fact of the matter is that there is no way you can stop this. You can put stuff forbidding it in your readme and people can still do it. We can ban people and people will still do it.

Example: You have a bike, and you get an idea that you're going to put a yellow lightning sticker on it. Your friend John has the same bike, and puts 2 blue lightning stickers on his, because he thought your idea was cool. Now John's friend borrows John's bike, puts a flame sticker on it, and wants to sell (I'M NOT RELATING THE WORD "SELL" TO MUGEN) this design of the bike. You can't give permission to John's friend to sell it just because it was inspired from yours, because it's not your bike. It's John's bike. He did the work of putting the blue stickers on.
Bike = Original guy's sprites from Kakuge Yaro
Idea of putting the stickers on = Your idea of the black superhero
Yellow sticker = Your original code
Blue stickers = XCB's code (he didn't edit yours IIRC)
Flame sticker = Fr33dom87's edits of XCB's code
It's like me making a Ryu called Awesome Ryu with SvC sprites, and then some other guy makes another Awesome Ryu that was inspired from mine, also using SvC sprites and has the overall same moveset BUT DID NOT USE ANY OF MY CODES, and then a 3rd guy comes along and edits the other guy's Ryu. I can't give permission to that guy because IT'S A STONE LUIGI.

Again the reason why I'm obliterating the whole policing issue is simple. I recently found out people had a hard time getting the character. I didn't make a updated version of him that was anywhere near complete as you can see from TrueStorm. Which was the newest version I made of SS. So when freedom told me about his edit I figure ok cool. Since my new versions are nowhere near complete people can have that. I was fully aware of who it was from and who edited it. The issue here is people wanted to be stuffy because it wasnt the original character ok so what.
Fact of the matter is long as its on the net its free to be done with as anyone pleases. By moral standing your supposed to say hey I edited this character and this is my version. That was done so he did what he had to do. As a tribute he came to me and said look I have this version do you mind. I didn't and seen it as a way to stop the missing or lack of getting SS. I am not concerned nor do I care about peoples silly views on how it came about. I was solving a much greater interest case in point. Since last night its been downloaded 310 times from 270 different ips. Which means the whole supply and demand is becoming not a issue.

Incorrect you fail at knowing the lore of SS. I never copywrited him wearing a gi and having lighting and wind powers. The gi was because I was a ken fan back in the day. And just used that as a vessel for the idea. My original idea is far more complex and vast then that. So stop talking about things your not sure of. Again the game idea SS is from is what is copywritten and I never said the game was called SilentStorm. He is just the lead character in it so stop spreading rumors.

Just to clarify, the only tie between permission and Fr33dom getting it relates to how the other communities handle him, and he was apparently attempting to keep it respectful. When that wasn't the case it got pulled.
Iced: He gave permission for the whole thing to be used, under a "everything's free" approach. Read his posts closer (I know, it's hard to but gotta do what you gotta do) and you'll see he stated that. That would be the primary issue.

I partly agree with your first sentence. The adjective form was primarly used to describe black neighboorhoods, good and bad ones. There was nothing positive about it's definition. But realize the times we're in - words mean different things for different subject matters. Meanings take on different things (some for good, some for bad). Yes, wordplay is tricky depending the crowd so it's best to chose words correctly...and if you feel that iffy, it's best to shut the fuck up altogether. After much thought, I decided to release this to the public as is. After the initial leaking of Jill and subsequent releases on warehouses, I have completely lost my drive to finish this. Now that the same thing has happened to Warusaki, I decided to release this in dedication to him.
I don't get it. MUGEN isn't that damn important. Why must people continue to hurt others just to procure sprites and code. Truth be told, half of them don't even play with the characters and just collect them for their ego's sake. It's a fucking shame that the characters are valued over the people who spend time, energy, and care to program them.
Hell, I'm willing to wager that 90% of the people who download this won't even read this. "OMG NO WAI! BIG KING ELI RELEASED JILL! HE'S BACK!!!!!111"
Anyway, maybe someone will take the time to finish the ol' girl. That'd make me happy, she deserves it. Maybe you can even use the engine to make your own MvC character. It's not perfect obviously, but it's a pretty good engine, much better than Venom's IMHO.
Obviously there is no Blaque readme to reference, so whatever. Anyway, sum-up: Open-Source -> Ask me first -> Open-Source.. I guess? Either way, it doesn't seem that Eli is in the school of "Don't use my shit or else" as it is heavily implied here, so this whole topic is pretty much pointless, especially considering that Guild (and pretty much the majority of the community) is okay with the "Open Source Movement" or whatever you wish to call it.

Words change SS. Gay was previously happy. Now it's homosexual. Sick was previously what you were when you felt awful, now it's a way of saying something is good.
Ghetto may have some negative connotations still but people round here do use it as a description for something that's cool. Cars and clothing mostly. Wandering round in a hoodie and ripped jeans is classed as ghetto and people like that because their style has been recognised.
