Can you use a rejected character concept for a project?

I've been wondering about this and when I tried to look it up, I don't get a straight answer.

Let's say that I were to open my own gaming company, and for a game we have the setting be a world consisting of only characters that were rejected.

By rejected I mean characters that were designed or thought up, but were scrapped, such as Zubaz and King Cobra from the Street Fighter series.


Or one of the rejected character designs of the Millenian and Bagan from the Godzilla series.


And since they were never used by their respective companies, would someone like me be able to use them for any project?

They are still copyrighted to their respective companies, you would have to change the design at least a bit or claim its parody.


Thats what the strip fighter team did when they used the female abel design.

What Iced said is true. Even if the concept characters or the artworks have not been released publicly, the intellectual rights are still owned by the respective authors or companies behind them.

This is what happens when developers move from one company to another, they could "reuse" some concepts from scrapped projects, but they can't do an exact or closely similar replica of it. For example, Maxima and K' are based on Daraku Tenshi characters, but there are subtle differences on these characters so as they are not considered copycats.

Zubaz also made it into Shovel Knight as 'The Baz'.



So yeah, it's not impossible, but you'd have to change it enough so that it's not just straight ripping off someone else's design work.

Also we don't know when are game companies gonna use the rejected concepts, oswald was designed since at least kof95 and he was not used until kof 11, so that's over 10 years later, prototype kyo was also used in kof2k, while he was obviously designed before kof 94. For all we know zubaz and king cobra can still be used in sf5.

there's also cool (k') and harry ness (maxima) from the unfinished daraku tenshi (fallen angels) game

this is just a case of the designer (styleos) jumping ship to another company tho
i cant count the reasons i should stay

one by one they all just fade away...
