You mean when the light on the side of your 3DS glows green? I believe you just have to be within range of each of the 3DS's.

If its that much different, maybe you need to notify me somehow. I don't want to have my 3ds on all day, cause I'm usually doing something, or going out. It's hard to tell when someone is on, or going to be on or not.
