If this is true and Nintendo lifted a ROM of Super Mario Bros. from the internet and then repurposed it for the Wii Virtual Console a decade ago it would certainly put Nintendo's policies against emulators in the spotlight.
The practice goes further back with Capcom readapting a pirate version of Street fighter( SF2 Rainbow I think ) to take some of the updates made in it into their normal games.Its didnt really put anything in the spotlight there either.
I don´t think Nintendo had downloaded a Super Mario Bros copy from the internet, I think Nintendo made a ROM from their own original copy because it is more safer, specially for avoid malware issues in theirs computers even of his clients.
Errr, sorry for not watching carefully the video but since I watched I don´t think Nintendo is breaking the emulation policies themselves, specially because their emulators and roms are of their own property, even if you download a rom you have a legal agreement for avoid to distribute a copy in internet.
